Hi all -
It has just come to my attention that there have been some ongoing school library bills that have made it to committee. They were proposed under vastly different topics (Scholars Summer Guide and hearing centers!!!) and only once the amendment was proposed is the language available.
HB843/SB1060 - Makes changes to the Age Appropriate Materials Act of 2022. 60 days for LEA book challenges - if the book is not reviewed in 60 days it is removed. In watching the video the legislators want to ensure that any book determination does not establish a contemporary community standard so that it will not impact other legislation with Title 39 such as the drag show ban.
  • Amendment  (language of the bill)
  • Current Status - Attempts to move it to summer study failed. As it hasn't been calendared in the Senate, it will probably be held until next year currently it is Placed on Regular Calendar for 4/6/2023 in the House.
  • Overview of bill: Makes changes to the Age Appropriate Materials Act of 2022. Declares that certain materials are not appropriate for a student in any of the grades K-12 and prohibits such materials from being maintained in a school's library collection. Requires the material to be reviewed by each local board of education (LBE) and public charter school from which feedback was received to be reviewed within 60 days from the date the feedback was received. Declares that a determination made on whether the material was appropriate does not establish a contemporary community standard. Requires the Textbook and Instructional Materials Quality Commission (Commission) to evaluate and determine whether a material in a school's library collection is appropriate upon request from certain persons who submitted feedback for material only if an LBE or public charter school governing body did not decide on a material for which it received feedback within 60 days. Requires the Commission to issue the Commission's determination in writing to each local education agency (LEA) and public charter school upon which each LEA or public charter school must comply.
HB0663/SB0966
  • Amendment (language of the bill)
  • Current Status: Placed on cal. Education Administration for 4/5/2023
  • Overview of bill: Makes various changes to the policies and procedures that each local board of education and public charter school governing body must develop pursuant to the feedback and review of materials located in a school’s library collection.
  • (Not quite sure how this bill will impact the policies and procedures enacted last year.)
Thanks,
Andrea
