Thought I would share.

The DOL’s Wage and Hour Division released a few opinion letters yesterday and the 2nd one is of interest given the opinion regarding extension service’s “nutritional instructors”.  The memo essentially states that a teacher does not have to be qualified as a typical academic professor and can have a high school diploma.  The exemption is valid if the employee is “teaching, tutoring, instructing or lecturing in the activity of imparting knowledge” and he or she is doing so as an employee of an “educational establishment.”  In addition, there is no minimum threshold to meet in this situation.

We’ve not had any discussion about this here on campus but wanted to share.

This release demonstrates the agency's continued commitment to providing meaningful compliance assistance to help employees understand their rights and ensure that employers have the information they need to comply with federal labor laws.
