The University of Kentucky is moving ahead with all planned changes, including salary increases for post docs and certain other staff members, plus converting about 400 (University-wide) exempt employees to non-exempt. Approximately 50 of those 400 employees are in the College of Agriculture, Food and Environment.

UF will proceed with increasing the salary of 1.00 FTE post docs to $47,476. However, we will wait on part-time post docs (which would have either been increased to 1.00 FTE at $47,476 or eliminated) and are waiting on making current exempt staff below $47,476 eligible for OT. Some supervisors had already given pay increases to staff they wanted to remain exempt. We will let those increases stand.

RE: FLSA Update
Date: December 2, 2016

On Tuesday, November 22, a federal judge granted a preliminary injunction against the Final Rule of the Fair Labor Standards Act (FLSA) which was issued in May. The FLSA rule, which increases the Minimum Salary Level threshold required for a job to remain "exempt" from the FLSA overtime and time recording requirements, had required implementation no later than December 1, 2016. The U.S. Department of Labor has announced that it will appeal the injunction, and it may be several months or even longer before there is a final resolution regarding the FLSA rule.

For now, Auburn University will take steps toward reconverting the jobs of full-time and part-time employees who were impacted when the University implemented the FLSA rule change. Effective January 1, 2017, their jobs will be reconverted from nonexempt to exempt. Please note that:

* Impacted employees (those whose jobs were recently re-designated) are still required to report their hours in Kronos until December 31, 2016, as their jobs will remain nonexempt until January 1, 2017;
* Impacted employees will also remain eligible for overtime premium until December 31, 2016;
* Additional information will be made available in the coming days; and,
* Auburn University will continue to monitor legal developments and will communicate any future changes or additional information as warranted.

Graduate student employees classified as graduate assistants (GAs) will not be reconverted to exempt status. Based upon definitions of all graduate student employee positions, GAs do not qualify to be exempt regardless of the Minimum Salary Level threshold. Graduate teaching and graduate research assistants (GTAs and GRAs) were not converted and will remain exempt under current regulations.
